General TOS, Intellectual Property Rights & General Usage

I, Cici Loveland(@gumballoflegend, @bluegumbii, or @gumballoflegendd), own the rights to produced works, regardless of whether they are in progress, completed, published, or unpublished. I do not consent, under any circumstance, to my artworks being used with or for AI and NFTs in any form, or legal action will be taken.My signature is not to be tampered with, copied, or removed, under any circumstance.I do not consent to the re-uploading of any of my artworks, regardless of intention, unless you have personally paid for the artwork. I must be credited using my chosen username for that platform, whether in the post itself or on your profile, for as long as my artwork remains on your account if you choose to post or publicly use a paid commission.I only exist as @gumballoflegend on Twitter, Discord, DeviantArt, Bluesky, Patreon, TikTok, Instagram, Tumblr, Twitch, Ko-fi, VGen, YouTube, Carrd, and Instagram, and as @gumballoflegendd on Reddit. Understand that if my artwork is posted under any other handle without proper payment and credit, is a mis-use of my artwork.I will not draw mechas, NSFW, kinks, fetishes, pedophilia, pro-ships, real people, NFTs, political artworks, or anything hateful or discriminatory regardless of the target.I draw only draw humans, animals, backgrounds, furries, Sonic OCs, vehicles, and robots. Note that an additional fee may be assessed if you are asking me to draw a complex robot.Understand that I am human, and that my work will be as close to perfection as I can possibly make it, but it will never be perfect, as this goes for any artist you may choose to commission.I do not consent to my artwork being used to spread hate, to harm, to bully, or to harass others, nor do I consent to it being used politically, fed to generative AI, used to promote racism, used to promote misogyny, used to promote homophobia or transphobia, used to promote pedophilia, used for NFTs, or used for bitcoin, whether it be static, animated, PNGTubers, emotes, VTubers, logos, icons, illustrations, or ANY other service I provide. Using my artworks to promote hateful and harmful people and groups such as ICE, Hitler, Donald Trump, Elon Musk, and any AI companies(Regardless of if the company is named here, if their primary purpose is to sell and/or distribute services with generative AI and AI language models, they fall under this category.), is a deliberate breach of contract and mis-usage of my works. Using my artworks in the manner mentioned above will result in the immediate revoking of your rights to ANY purchased artworks regardless of whether or not they are paid in full, the commission (if open) being marked as complete & progress being halted permanently regardless of what phase it is in without refund, and immediate termination from all future communication and services. You will be blocked on all social media and all future communication will be prohibited.I have the right to decline any commission or request.

Payment Policy for Commissions

Payment must be submitted and cleared in order for me to begin work on your commission. I do not accept payment on any other platform than VGen.Regarding Payments & Payment Plans
* For orders $119 and under, payment must be completed up front and in full in order for work to begin.
* For orders $120-$250, you are allowed to split the order into two payments and submit a 50% down payment to secure your place in the queue. If you choose this option, the other half of the payment must be submitted before the fully rendered model is presented to you(& before rigging begins).
* For payments $251+ you are allowed to split the order into four payments and submit a 25% down payment to secure your place in the queue. The second payment must be submitted when work begins, the third payment must be submitted before I present the line-art to you, and the fourth/final payment must be submitted before the fully rendered model is presented to you(& before rigging begins).If your order is eligible for a payment plan, please message me before placing your order OR enter the payment plan request in the 'Extra Info' slot in the order request form. Otherwise, I will assume you will be paying for the order up-front and in full, and will send you a proposal requesting such.Pricing & Taxes
I price my artworks based upon my desired hourly pay, my skill, an estimate of the time taken to complete the artwork, the coloring style, the subjects, and the complexity of it. My prices are set in stone and are not to be bargained with, as I will not accept anything less than the listed price.Due to my position as a freelancer, and the freelancing tax that is imposed on me here, I include a 15.3% sales tax for orders $50 and over. This is not something I want to do, as I do not like collecting taxes, but please understand that this is something I must do to keep myself afloat.Fees
* I charge a percentage-based rush fee depending on complexity for orders placed with less than a month in advance of a hard deadline. This allows me to prioritize your commission without losing out on money.
* I charge a percentage-based fee for characters that are more complex to draw, ranging from 10% to 30% upcharge based on the complexity of the character. (For example, highly accessorized characters, or characters with scales.)

Revisions Policy for Commissions

You are entitled to one complete do-over of the purchased artwork, only applicable during Phase 1, as detailed in the section above titled "Process." Note that this does not apply when I am merely thumbnailing the artwork-- you may have the artwork adjusted as need be during the thumbnail phase.There will be a fee for any additional do-overs once we are in the sketch phases after you have used your first one. I will adjust the drawing as need be, but I do not do repeated, meticulous line adjustments. Drawings, as mentioned above, will be as close to perfection as possible, but will never be perfect, and this goes for anyone you may choose to commission.

Deadlines & Delivery Policy for Commissions

My commissions work on a first-come-first-serve basis. When I contact you to discuss the commission and collect payment, I will let you know your place in line. Your order must be paid in full or must have a down payment in order to secure your place in the queue, as well as the promised delivery date in my sent proposal.Each commission will have its own estimated delivery date. This date is only applicable once I have, in writing, notified you that I have officially started your commission. The estimated delivery date is invalid unless I have notified you of the process beginning.If you are purchasing an artwork with a deadline in mind, I must be notified of this deadline. I will not accept any artworks that allow me less than three weeks to start and finish.

Commercial Usage

If you intend to resell a commissioned artwork, whether it be digitally or physically, a one-time commercial fee must be paid up-front. Regardless of artwork, this commercial fee will be 100% of the total price.

Harrassment & Treatment Policy

I will not tolerate mistreatment in any form. I will warn you of your unpleasant behavior and how it makes me feel, and if your behaviors do not cease, your artwork will be marked as 'completed' regardless of what phase it is in, work on your order will cease permanently, and no refunds will be given, as your mistreatment of me is a deliberate breach of contract.Mistreatment towards me can be described as making me feel uncomfortable, spreading misinformation about me, calling me names, berating me, attempting/implying blackmail against me regardless of evidence, twisting my words, insulting the work I am doing for you, guilt-tripping me, etcetera. Regardless of whether or not it is listed, if you engage in any any harmful and/or uncomfortable behavior towards me, my business, my name, or REGARDING anything to do with me, this will count as mistreatment. If you are warned of your harmful behaviors yet choose to continue, you will not be entitled to a refund, as this is classified as a deliberate breach of contract.

Refund Policy

I do not offer refunds unless I determine that I am physically or mentally unable to complete your commission and notify you of my change of mind. Refunds, if offered and/or accepted, must be completed using the original payment method. If a refund is offered or accepted due to my own failure to complete your artwork, I will offer the conversion fees necessary to return the full amount of money you paid to me back to you.I do not offer refunds in cases where one or more of my policies has been violated. Chargebacks and disputing my account is prohibited and a deliberate breach of contract. If you attempt to initiate a dispute or chargeback, all messages shared between us will be made public, you will be put on a public blacklist, you will be blocked and banned from all future communication with me, and I will warn others of you on social media.Refunds are invalid unless I, in writing, have informed you that I am initiating a refund, regardless of whether or not you attempt to dispute me or initiate a chargeback.

Communication

I will thoroughly communicate the status of your commission and ask for feedback throughout the process. If I am asking a question regarding your opinions on the current state of the artwork, if anything needs to be changed, or similar questions regarding the process of the commission, it will be temporarily put on hold until I hear a response from you.If you fail to respond to me after two weeks, your commission will be put on hiatus. If you fail to respond to me after a month has passed, your commission will be marked as 'complete' and will no longer be worked on. No refunds will be given for a lack of communication on your end.

Support & Friendship Policy

Due to a bad experience with a previous client, I now feel the need to include this in my TOS:Understand that by supporting me financially, I will be extremely grateful, but it does NOT invite you to treat me like a close friend. If a friendship bond forms naturally, I won't be opposed to it, but buying something from me is NOT an automatic invitation into my life. I am running a professional business in order to support myself, and would like any future transactions to remain as such.

Discount Policy

In order to show my appreciation for my supporters, I offer a variety of discounts depending on if you are a server booster in any of my Discord servers, a subscriber to my Patreon, or a subscriber to my DeviantArt. These discounts are stackable, however, the maximum stackable discount with any subscriber, booster, or any ongoing shop discounts is 40% OFF if an order is $31+ before any sales. If an order is $30 and under before any sales, the maximum stackable discount is instead 25% OFF. VGen commissions are my source of income, so I can't give more expensive orders away for free, unfortunately. I thank you for your understanding, and all that you do.Loyalty Cards
Now that loyalty cards exist, you may choose to enroll in their usage at any point in time if you are currently paying for or have previously paid for a commission.Loyalty Card discounts, as well as dollar discounts from Patreon subscriber benefits, will be processed before percentage-based discounts.

Breach of Policy / Contract

By attempting a purchase from me, you have read over my terms of service and fully consent to them. You acknowledge that you may not claim ignorance if you fail to uphold these terms.

Streaming & General Video Content TOS

Regarding Personal, Monetized & Commercial Content Licenses
In order to make commissioning me a little bit more affordable for my clients, all PNGTuber & VTuber commissions include personal & monetized content licenses. This means that you can use the model in content that collects tips or any other form of payment. The model may also be used when promoting yourself or a sponsored brand.Regarding Credit
You do not have to credit me in every video or livestream, as I understand that is unrealistic. However, if you have channel credits, a Carrd/Linktree/similar platform for links, or an extended bio, I ask that you list me there as the person responsible for your model's art & rigging if you ordered something from me. Put simply, this may help direct future clients to me. I will not ask that you do anything more than that.

NSFW TOS

I will only accept NSFW commissions from those that are 18+, with valid PROOF of age. In order to verify this, I will request a picture of your ID with a hand-written piece of paper next to it that says your username on it. You may censor it as you like, as long as your name and date of birth are visible. If the name on the ID does not match up with the one on the PayPal account, I will deny your request. If your ID is not accompanied by a hand-written paper with your the username of the account you are purchasing from, I will also deny your request.Ensuring that I do not sell NSFW to minors is extremely important to me. Not just due to the legality of it, but because attempting to purchase NSFW from an adult as a minor poses a very serious risk to both of us. Please respect that I only want to keep you and I safe.Additional & Important NSFW Rules:
* I do not age-up characters for NSFW, nor will I draw any characters that are meant to be depicted as children for NSFW. Any attempt to ask for this is an immediate block. Only characters/OCs that are canonically depicted as adults are permitted, even if their age is not strictly mentioned.
* I will draw some fetishes/kinks, as well as gore. I will NOT draw vore, age-play, flattened characters, or anything involving defecation or urine. If you would like to know if I will be okay with drawing your fetish/kink, message me privately before ordering.
* I will not draw characters with wildly-exaggerated proportions. I'd be willing to draw a character with a thicker/fat body, but I am not willing to draw their proportions in a comically/obscenely exaggerated way. If you have any questions about this, ask me before ordering. (Essentially, think of goonerslop. I will draw NSFW, but I will NOT draw goonerslop. It has to have some soul and love to it, rather than just being porn for the sake of porn.)
